Foreigner’s Korean Investment Corporation Establishment Procedure
The D8 visa Korean investment company establishment procedure proceeds in the following order.

1. Foreign investment report / account opening (bank)
First, you must visit a bank to report foreign investment and open an account.
- Reporter: Foreign investor or agent (power of attorney)
- Reporting place: Head office or branch of a designated domestic bank / Domestic branch of a foreign bank
- Documents to be submitted
- 2 copies of foreign investment notification by way of acquisition or contribution of stocks, etc.
- Proof of nationality of foreign individual investor (copy of passport)
- Certificate of incorporation in the case of a foreign corporate investor
- Power of attorney (in case of reporting by proxy)

2. Remittance of investment funds
Remittance of investment funds from overseas to the opened account.
- Remittance Method: Remittance or Carry-in (Declare to customs and receive “foreign exchange declaration certificate”)
- Exchange money and deposit it into a custody account
- The bank issues a foreign exchange purchase certificate, and this certificate is required for corporate registration.
3. Establishment and registration of a corporation (registry office)
Investor personal documents, bank documents, remittance related documents, etc. are collected to prepare corporate company establishment documents and register them at the registry office.

- Incorporation by erection: within 2 weeks from the date of completion of the investigation on the progress of establishment

- Corporations need at least one promoter

4. Business Registration / Notification of Incorporation (Tax Office)
When the corporation registration is completed, visit the tax office to register the business and report the establishment of the corporation at the same time.
∗ Usually, the notification of incorporation and the application for business registration are filed simultaneously on one sheet of paper kept at the tax office.
- Where to apply: Tax office having jurisdiction over the location of the head office or KOTRA (competent tax office is limited to Seoul)

- In most cases, business registration and corporate incorporation report are processed at the same time by the competent tax office.

In case of business registration first
- Generally, the notification of incorporation and the application for business registration are filed at the same time.
- When a foreign investor establishes a corporation by making an investment in kind, a business registration certificate is required to receive a refund of VAT upon customs clearance of the object of investment in kind.

5. Transfer of paid-up capital to corporate account (bank)
Upon completion of the incorporation registration and business registration procedures, the new company acquires corporate qualifications, and the paid-in capital stored in the bank can be transferred to the newly established corporate account.
♦ When transferring paid-in capital to a new account, a certified copy of corporate registration, certificate of corporate seal, corporate seal, copy of business registration, seal to be used in bankbook (individual/corporate), and original ID of the CEO are required, and each bank requires different documents. .
6. Foreign-invested company registration (bank)
Upon completion of the above procedures, the bank will issue a foreign-invested company registration certificate.
